by Miriam G.Desacada Tacloban City— The Quezon City Regional Trial Court (RTC) Branch 82 dismissed a civil case for permanent injunction filed by Mark Lester A. Limpin and Roberto R. Seelin against The Fraternal Order of Eagles – Philippine Eagles, Inc., led by National President Ronald Delos Santos. In an Order dated February 23, 2026, issued by RTC Branch 82 in Quezon City, the court granted the affirmative defenses raised by the defendant organization and dismissed Civil Case No. R-QZN-25-08300-CV, which sought a permanent injunction with damages and attorney’s fees.Grounds for Dismissal The court ruled that the plaintiffs lacked the legal capacity and standing to file the case. According to the Order, the Securities and Exchange Commission (SEC) had revoked the corporate registration of the organization represented by the plaintiffs as early as 2013. The court emphasized that a corporation whose registration has been revoked no longer possesses juridical personality except for purposes of liquidation. Because of this, the court held that the plaintiffs could neither sue nor represent the corporation in enforcing trademark rights. The court also ruled that the plaintiffs were not the real parties in interest, stating that the trademark in dispute is a corporate asset and cannot be claimed by individual members or officers without proper authority from the registered corporation. Furthermore, the court emphasized that only the legitimate owner of the trademark has the right to file a case involving its protection or enforcement.Recognition of Legitimate Organization With the dismissal of the case, the The Fraternal Order of Eagles – Philippine Eagles, Inc. under the national leadership of Ronald Delos Santos continues to be recognized by its members as the legitimate organization authorized to use and protect the official name and trademark.In Eastern Visayas, the organization operates under the leadership of Regional Governor Ronnie Cornico, with jurisdiction covering Tacloban City and nearby areas. Members in the region maintain that only Eagles chapters affiliated with the national organization led by Delos Santos are authorized to use the official identity and trademark of The Fraternal Order of Eagles – Philippine Eagles. Background of the Case The case stemmed from a long-standing organizational dispute that began years ago after a faction broke away from the national organization. The breakaway group attempted to assert rights over the organization’s name and trademark, resulting in legal action. The RTC ruling effectively dismissed the injunction case and affirmed that the plaintiffs failed to establish any enforceable legal right over the trademark. The court concluded its Order with a directive dismissing the complaint in full. “WHEREFORE, based on the foregoing, the Affirmative Defenses are GRANTED. The Complaint for Injunction… is ordered DISMISSED,” the Order stated. The decision is considered a significant development for members of the organization nationwide, particularly in Eastern Visayas, where affiliated chapters continue to operate under the recognized national leadership.
